Please read these Terms and Conditions carefully before booking or using our services.

1. Introduction

These Terms and Conditions govern your access to and use of the website https://www.newbornbabyshoot.com/ and all photography services provided by Dheers Photography.

By booking a session, making payment, or using our services, you agree to be bound by these Terms.

3. Booking and Payment Policy

  • A session is confirmed only upon payment of 50% of the total package amount as advance.

  • The booking advance is strictly non-refundable under normal circumstances.

  • The remaining 50% balance must be paid on the day of the shoot before image selection.

  • Twins baby shoot: The second baby will be charged at 50% of the applicable package rate.

  • Prices are subject to change until booking is confirmed.

4. Rescheduling and Cancellation

  • Rescheduling is subject to availability and studio approval.

  • Last-minute cancellation, postponement, or no-show will result in forfeiture of the advance amount.

  • In exceptional cases such as medical emergencies or government restrictions, rescheduling may be considered at management discretion.

5. Shoot Timing Policy

  • Sessions will be conducted within the scheduled time slot.

  • Clients are requested to arrive on time.

  • Late arrival may reduce the shoot duration without time extension.

  • Additional time, if available, may be chargeable.

6. Child Supervision

Parents or legal guardians are solely responsible for supervising children during the entire session.

Dheers Photography and its team are not responsible for:

  • Monitoring minors

  • Preventing accidents

  • Managing child behavior

  • Any injury occurring during the shoot

7. Studio Property and Props

Clients are responsible for any damage caused to studio property, equipment, décor, furniture, backdrops, or props by themselves, their child, family members, or accompanying guests.

Repair or replacement costs shall be payable by the client.

8. Image Selection Process

  • After full payment is completed, images will be uploaded to a private online gallery link for selection.

  • Clients must select images for editing as per their package.

  • Image selection must be submitted within 5 days of the shoot.

  • Delay in selection may affect delivery timelines.

9. Editing and Final Delivery

  • Only selected images will be edited and delivered.

  • Raw/unedited files are not included unless purchased separately in writing.

  • Final edited images will be delivered within 15–20 working days from the date of selection.

  • Images will be delivered via secure online link in high-resolution format.

  • Editing style and creative direction remain at the discretion of Dheers Photography.

10. Copyright, Privacy and Usage Rights

  • As per the Indian Copyright Act, 1957, the photographer remains the first and exclusive owner of all images.

  • Clients receive a personal-use license only.

  • Full copyright transfer, exclusive privacy rights, logo-free images, and RAW files are available at additional cost upon written agreement.

  • Unless privacy is requested in writing before the shoot, the Company reserves the right to use selected images for portfolio, website, social media, marketing, awards, and promotional purposes.

11. Limitation of Liability

The total liability of Dheers Photography under any circumstance shall be limited to the amount actually paid by the client for the specific booked service.

The Company shall not be liable for:

  • Loss of profits

  • Emotional distress

  • Missed moments due to technical failure beyond control

  • Delays caused by external factors

12. Force Majeure

The Company shall not be held responsible for delay or failure to perform due to circumstances beyond reasonable control including natural disasters, government restrictions, power failure, illness, or equipment breakdown.

13. Governing Law

These Terms shall be governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh.

14. Changes to Terms

Dheers Photography reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
